CySEC Launches New Rules for Digital Onboarding
The Cyprus Securities and Exchange Commission (CySEC) has unveiled a new set of rules aimed at enhancing digital customer onboarding, as outlined in its recently released Policy Statement (PS-01-2024). This initiative, announced on August 6, 2024, marks a significant step in modernizing the regulatory framework for financial services in Cyprus, particularly in light of evolving digital practices.
Background and Development
The new rules emerged from extensive consultations with stakeholders, which were part of a public consultation process (CP-02-2020) that sought to gather insights and feedback from various industry participants. This collaborative approach ensured that the regulations reflect the realities of the market while aligning with the latest guidelines from the European Banking Authority (EBA), which were finalized in October 2023. These EBA guidelines provided a foundational framework that influenced CySEC’s new policy direction.
Key Components of the New Rules
One of the most notable aspects of the Policy Statement is its endorsement of remote onboarding solutions for “Obliged Entities,” as defined under the Prevention and Suppression of Money Laundering and Terrorist Financing Law of 2007. This allows financial institutions to verify the identities of customers who are not physically present, thereby facilitating a more streamlined onboarding process. However, the implementation of these remote solutions is not without safeguards. CySEC emphasizes a risk-based approach, mandating that Obliged Entities conduct a thorough risk assessment before employing remote onboarding methods. Furthermore, these entities are required to notify CySEC of their intention to use such solutions in advance, ensuring regulatory oversight and compliance.
Expanded Definition of Identification Documents
Another significant update is the introduction of the term “identification document,” which expands the types of acceptable documents for customer verification beyond just passports. This change is designed to accommodate a wider range of identification methods, reflecting the diverse needs of customers and the realities of digital transactions.
Address Verification Process
While the requirement to collect documents confirming a customer’s address remains intact, the new rules allow for the collection of copies of original documents through remote onboarding solutions. This adjustment aims to simplify the process while maintaining the necessary checks to prevent fraud and ensure compliance with anti-money laundering regulations.
CySEC’s new digital onboarding rules signify a proactive approach to integrating technology into the financial services sector in Cyprus. By balancing the facilitation of digital processes with robust risk management practices, the commission aims to enhance customer due diligence while fostering innovation in the industry.
